Hadley Quoted in ‘Law360’ on USPTO Announcement of New PTAB Procedures
Glaser Weil Intellectual Property Partner and Chair Lawrence M. Hadley was interviewed by Law360 in a piece titled “New PTAB Rule Could Lead To Rush Of Bids For Vidal's Eye” regarding the recent announcement allowing litigants to petition the U.S. Patent and Trademark Office Director, Kathi Vidal, to reconsider unfavorable PTAB decisions.
Hadley noted that while patent owners have other options like appealing to the Federal Circuit, their petitioner counterparts have no other alternative other than filing requests for director review so “it would almost be malpractice not to do it, even if only 1% of these end up being granted,” adding yet another "costly and time-consuming hurdle that patent owners have to face."
