Patent and Trade Secret Litigation

• Aqua Connect, Inc.,  in securing a $5.7 million patent infringement victory in Delaware federal court against TeamViewer US and TeamViewer Germany regarding remote connection software patents, and successfully defending both patents in USPTO ex parte reexaminations.
• Textron Specialized Vehicles, Inc., in successfully enforcing patent rights pertaining to golf car design against overseas importers and achieving a settlement that resulted in the discontinuation of infringing sales.
• UUSI LLC d/b/a/ Nartron, an early pioneer in touchscreen technology, in patent infringement actions against Samsung and Apple alleging infringement of its capacitive touch response patent, which is foundational to today’s modern touchscreen technology. Matters include numerous inter partes review (IPR) challenges and federal circuit appeals from IPR decisions upholding the validity of our client’s patent.
• Core Optical Technologies, as trial and appellate counsel, in achieving a major patent victory in a matter involving advanced fiber optic technology. The Federal Circuit Court of Appeals issued a precedential decision overturning a district court’s summary judgment decision that our client did not own the patent it accused manufacturers of fiber optic receivers of infringing.
• A mobile payment company that holds over 60 patents in IPRs filed by Samsung against eight patents in the mobile payment and non-browser-based app space. Filed Patent Owner Preliminary Responses in each IPR, and the PTAB agreed and declined to institute any of the IPRs on the merits. In related district court action, defeated Samsung’s efforts to hold the patents ineligible under Section 101.
• An early pioneer of Find My Device technology in an patent infringement action against LG Electronics in the Western District of Texas.
• Spinal Generations, LLC, a retired surgeon’s patent company, in a patent infringement case against DePuy involving orthopedic surgical instruments in the U.S. District Court for the District of Delaware.
• StemExpress, LLC, a life sciences company,  in federal trade secret litigation over blood separation technologies against a former business partner who formed a competing company, ultimately securing a confidential settlement shortly before trial, and in a separate state trade secret misappropriation case against a former sales employee and her new employer.

Copyright and Trademark Litigation

• Michael Gaffney, Muhammad Ali’s personal photographer, as the plaintiff in a copyright infringement case against Authentic Brands Group LLC.
• Jeffrey Sedlik, a world-renowned, award-winning professional photographer, in a case involving the unlicensed use of his copyrighted photographic portrait of world-famous jazz musician Miles Davis by tattooist Kat Von D of “Miami Ink” and “LA Ink.”
• D’Pergo Custom Guitars, Inc., a custom maker of high-end handcrafted guitars, in a copyright and trademark infringement case against Sweetwater Sound, Inc.
• Brittney Gobble Photography in successfully challenging a copyright infringement case against the defendant, Sinclair Broadcast Group, a large publicly traded American broadcast television company.
• Pop-A-Shot Enterprise, LLC, in obtaining a preliminary injunction in a trademark infringement action against a sporting equipment manufacturer and negotiating a settlement that resolved a dispute over sales of infringing products containing the Pop-A-Shot name.
• A beauty model and social media influencer as plaintiff in a successful rights of publicity and copyright infringement lawsuit against four Fortune 50 defendants.
• A wellness brand in a Trademark Trial and Appeal Board proceeding brought against it by a pharmaceutical company. Experience included successfully defending the company, thereby permitting some of the client’s trademark applications to proceed to registration.
• A stand-up comedian, writer, actor and creator/host of a popular podcast in an intellectual property ownership dispute with a cohost following their business divorce.

Intellectual Property Counseling, Licensing and Technology Transactions

• A super-grid company as lead counsel and intellectual property counsel, in a large-scale alternative energy telecommunications, infrastructure and manufacturing project to build the largest super grid in the world.
• Scepter, Inc., a company designing and launching a satellite constellation for measurement of greenhouse gases and criteria air pollutants. Work includes protecting, exploiting and enforcing the company’s intellectual property, in addition to drafting and negotiating deals and capital raises to support its growth.
• InCharge Energy, the leading developer of commercial EV charging systems, with respect to the clients’ IP protection, enforcement and licensing with a significant valuation for its hardware, software and service for electric vehicle fleet charging solutions for companies like UPS.
• TriMed Inc., a global developer of market-leading orthopedic implants, with various intellectual property aspects of its sale of a majority interest to Henry Schein, Inc. (NASDAQ: HSIC), the world’s largest provider of health care solutions to office-based dental and medical practitioners.
