Glaser Weil Triumphs in $5.7M Patent Suit, Defeats USPTO Ex Parte Reexaminations
Glaser Weil has once again prevailed in its representation of Aqua Connect, Inc. (“Aqua Connect”), a software company, in its patent infringement dispute against TeamViewer US and TeamViewer Germany (“TeamViewer”). Aqua Connect holds patents on remote desktop software that allows any type of computer, including Windows-based computers, to remotely control Apple devices, including laptops, desktops, iPhones and iPads.
In August 2022, Glaser Weil’s Intellectual Property team prevailed in a patent infringement jury trial against TeamViewer, securing a damages award of $5.7 million (before interest). After the weeklong trial in the U.S. District Court for the District of Delaware, the jury returned a clean-sweep verdict for Aqua Connect, finding TeamViewer liable for direct and indirect infringement of both patents-in-suit, and confirming both patents as valid.
After the district court upheld most of the jury’s verdict on post-trial motions, TeamViewer filed requests for ex parte reexamination with the USPTO, seeking to cancel the patents-in-suit. Glaser Weil represented Aqua Connect in the reexaminations. On October 10 and 15, 2024, Glaser Weil prevailed, with the USPTO confirming the patentability of both patents.
These most recent successes not only back up Glaser Weil’s trial win in August 2022, but illustrate the firm’s ability to successfully represent clients in complex patent matters that include both district court litigation and parallel USPTO proceedings.
